Emailing and CAN-SPAM Compliance Policy

LCM Design LLC and Boat-Mail (jointly referred hereinafter as “Boatmail”) is enforcing a zero tolerance policy against Spam. Boat-Mail’s staff will actively monitor and review emailing lists provided by its customer and emailing results for evidence of an unusual number of spasm according to industry standard. If any of our customers is found to be using Boatmail services for spamming purposes Boatmail reserves the right to interrupt immediately and without notice all services without right of any kind of refunds. Furthermore, our clients are invited to report any suspicious activity at contactus@boat-mail.net.

 

CAN-SPAM Compliance:

January 1st 2004 the CAN-SPAM act of 2003 (Controlling the Assault of Non-Solicited Pornography and Marketing Act) became effective.

The CAN-SPAM act applies to emails whose primary purpose is advertising or promoting a product or service.

The law’s main provisions require:

  • That you clearly identify yourself. The “From” “To” must not be misleading.
  • Prohibits deceptive subject line that must clearly indicate to the recipient what the subject or matter of the message is.
  • Requires that your email provide the recipients with an opt-out method.
  • Requires that your email be clearly identified as an advertisement and includes sender’s valid physical postal address.

Consent Rules:

If the CAN-SPAM act of 2003 is a starting point, we will not stress enough that all emails can be treated as spam unless you receive prior consent to send email communication from the recipient or that you had a pre-existing business relationship with the recipient.

According to the above noted definition, the following may be included in your emailing list:

  • Customers that have expressed the desire to be contacted by email through a subscription form (electronic or paper format).
  • Customers that have given you their business card and you have explained to them that you might be contacted them by email.
  • Customers that have purchased something from you within the last 2 years.
  • Co-sponsored e-mailing campaign where the “owner of the authorization” co-signs and is clearly identified as a sponsor of the message that is sent to the recipient.

 

What should not be included in your emailing list:

Anything that does not fit in one of the above definition and certainly not any of the following:

  • Addresses that you bought loaned or rented from a third party. No matter whom that third party might be and what they claimed about quality and or permission.
  • Addresses you acquired yourself from any source without the recipient knowledge. That would include email addresses you found on the internet or in any paperback directory.
  • Addresses you haven’t contacted by email in the last 2 years.

Boatmail is a “consent driven” marketing provider and we will make every effort to help our client comply with anti-spam regulations. In that effort:

  • By accepting our Terms of Use (“TOU”) you have already made representation that you will be using only Consent Rules for your emailing list and never to sell or rent your lists.
  • Boatmail will only use valid information known at the time that identify you as the sender and will reject the use of all email addresses deem suspicious.
  • Boatmail will mandate that all emailing message contains your contact information including your physical mailing address.
  • Boatmail will require that all emailing message include an unsubscribe link which allows your contacts to opt-out of future emails communication.
